October 23, 2026: The Trump administration has announced a series of measures and investigations focused on alleged fraud and compliance risks in US temporary visa programmes, including H-1B employment visas and J-1 exchange visitor visas. Officials say the actions are intended to protect programme integrity, workers and national security.

    Recent H-1B programme measures

A White House order dated September 18 calls for stronger interagency coordination and enhanced scrutiny of certain H-1B applications where officials identify heightened risks, including possible displacement of US workers. The administration has also extended restrictions affecting entry of certain nonimmigrant workers.

    J-1 investigations

The US Department of Labor’s Office of Inspector General said on October 9 that it had launched an investigation into potential fraud in J-1 programmes at nine universities and that subpoenas had been served. An investigation is not a finding of wrongdoing by every institution or visa holder involved.

What applicants and employers should know

    • Provide accurate information about job duties, wages, qualifications and programme purpose.
    • Keep contracts, offer letters, academic records and supporting documents consistent.
    • Employers and programme sponsors should review compliance obligations and respond to official requests.
    • Applicants should rely on official US government guidance or qualified immigration counsel for individual cases.

Will this affect all visa applicants?

The rules and scrutiny depend on the visa category, the facts of the application and the applicable government policy. A policy announcement or investigation does not mean that every H-1B or J-1 applicant is suspected of fraud. People with pending cases should monitor official updates and seek advice for their circumstances.
